** In settlement of a racketeering indictment filed by the United States government against the Teamsters, the Teamsters have agreed to be monitored by an “Internal Review Board (IRB)” that has rules that make a company disciplinary hearing look like a fair process.  Union members and officers in the Teamsters have substantially fewer due process rights than members and officers of other Unions and many members and officers of the Teamsters have been permanently expelled from the Union in this process.  Many of those expelled from the Union should have been permanently expelled but some of those expelled have gone on to be exonerated by juries and are still expelled from the Union .  The attached document is a research paper that was prepared using the IRB report to the United States District Judge which retains jurisdiction over the consent decree which settled the government’s racketeering case against the Teamsters. If you want to be a Teamster be prepared for the investigators from the IRB to be coming to your office without a warrant and searching through your papers.  The IRB has the right to investigate and expel from the Union anyone who “brings reproach” upon the union.  In the heat of negotiations and the federal government is putting pressure on you to cave and accept less who wants to find out what “bringing reproach” means in a process where fundamental democratic rights are eliminated.  In this arena how do you think the IRB will look upon anyone discussing Resolution 42 should conditions mandate that the resolution be implemented?   10/03
